Consignment Terms of Service

We're delighted that you've selected Turning2Sports, LLC to support youth athletics and champion sustainability! This agreement, known as the Consignment Terms of Service, establishes a contract between you and Turning2Sports LLC ("Turning2Sports") when you provide goods to Turning2Sports (referred to as the "Agreement"). Quick Details

Turning2Sports specializes in marketing and selling pre-owned Youth Athletic Gear and Equipment. Upon receiving the items sent to us or collected from you, Turning2Sports meticulously inspects them to prepare for listing on our website (referred to collectively as the "Property") on a consignment basis. It's important to note that even after the physical transfer of the Property to Turning2Sports, you the owner retain ownership.

Following the processing of your Youth Athletic Gear and Equipment by Turning2Sports, we will notify you regarding the acceptance of any items for sale and the recommended consignment price set by Turning2Sports. You will have a 48-hour window to request an adjustment to the posting price; otherwise, the price set by Turning2Sports will be posted. For any price adjustment requests, contact us at admin@turning2sports.com. Once accepted, the items will be processed and listed for sale on Turning2Sports.com.

Your Information

When you create an account and consign items with Turning2Sports, it is essential to maintain accurate contact, payment, billing, and related information. The information you supply must be truthful, specific, and complete throughout the consignment process. This includes providing Turning2Sports with necessary details such as a valid email address, postal address, and relevant banking/Venmo/PayPal account information. It is your responsibility to ensure the accuracy and completeness of your information, as Turning2Sports is not liable for communication errors resulting from inaccurate or incomplete details.

You are also accountable for ensuring that you can receive emails from us, and Turning2Sports cannot be held responsible for any emails that go unreceived due to being blocked or filtered as junk mail or spam.

What We Accept

Turning2Sports exclusively accepts items that adhere to our stringent acceptance standards, reserving the right to reject items for any reason. Each item undergoes an evaluation, at our sole discretion, to ascertain whether it meets the following, but not limited to, conditions:

  • Is in good, excellent, like-new, or new condition.

  • Must have been laundered and free from odor.

  • Is devoid of large stains, pilling, fading, extensive rips, unmendable holes, substantial tears, indications of excessive wear, remains functional, is not missing parts, has not been altered, and retains visible tags and labels.

  • Is not counterfeit not illegal.

  • Aligns with the representations and warranties made in the "Your Representations, Warranties, and Indemnification" section below.

Items Listed on Third-Party Platforms

Any gear and equipment consigned using Turning2Sports cannot be listed on any other third-party platforms, auction websites, etc.

Consignment Period and Return Of Property

The "Consignment Period" for each item of Property initiates on the date Turning2Sports accepts the item for consignment and concludes 200 days thereafter. In the event that an item remains unsold by day 150 of the Consignment Period, Turning2Sports will reach out to you. You have the option to choose whether to (1) have the item returned to you at your expense or (2) authorize the donation of the item to a charity selected by Turning2Sports.

Throughout the Consignment Period, and contingent upon this provision, you may, at any point, submit a written request to Turning2Sports for the return of the item, provided the item has not been Sold. When Turning2Sports receives your Return Request, we will make commercially reasonable efforts to promptly remove the item from Turning2Sports.com before any sale occurs.

Should you opt for the return of an item, you are responsible for covering the shipping costs at the prevailing market rates. If an item is rejected for posting or remains unsold, and there is no response to Turning2Sports' requests regarding the item's return or donation after 15 days, Turning2Sports retains the discretion to donate or recycle the item.

In the event that, at the conclusion of the Consignment Period, Turning2Sports is unable to contact you using the provided email on file, the item may be donated or recycled at Turning2Sports' discretion.

Title to Property

As the consignee, you keep the ownership and title of each item of Property until the item is officially deemed "Sold." An item is considered Sold when: (1) Turning2Sports completes the sale to a customer, and the item is not returned within the stated Return Policy period; or (2) the item is lost, stolen, damaged, or destroyed while in Turning2Sports' possession. Turning2Sports defines possession as the point at which goods are received and loaded posted on www.turning2sports.com.

Pricing

Listing prices are determined through a comprehensive evaluation of various factors, including but not limited to the estimated retail price, anticipated age or remaining useful life of the gear, overall condition, cleanliness, market trends, brand reputation, demand, seasonality, and the specific type of gear. In instances where an accurate retail price for your property cannot be determined, Turning2Sports will make its best effort to estimate the retail price based on comparable products or categories.

Regarding price adjustments, once your item has been accepted, you will receive an email presenting our suggested price. You are given a 48-hour window to make adjustments. The maximum allowable adjustment is 80% of the estimated retail price set by Turning2Sports. The price you choose will be listed for thirty days, and then:

  • Turning2Sports may decrease the price to find the optimal selling price based on market conditions, demand, and seasonality. This can be up to 85% off the Retail Price.

  • Turning2Sports may offer additional discounts and promotions during the Consignment Period, at its sole discretion and without notice to you, to efficiently market and sell the Property

After your gear has been listed for 150 days, you will receive another email with the following options:

  • Donate — Donate your gear to a good cause.

  • Return to You — We can send your gear back to you. (You will be responsible for return shipping costs.)

In the absence of any action within 200 days, your gear will be donated. To keep you informed about the remaining time on your posting, we'll send multiple reminder emails. Opting to donate your gear means you contribute to supporting young athletes through nonprofits that provide encouragement and coaching.

Your Representations, Warranties, and Indemnification

You affirm and guarantee that (a) you possess good and marketable title to each item of Property, with the right to sell and consign said Property; (b) none of the Property is subject to any liens or other encumbrances; (c) the Property does not encompass stolen or counterfeit goods; (d) the Property is legally eligible for sale; and (e) the Property does not infringe upon, misappropriate, or violate any trademark, copyright, or other intellectual property or proprietary right of any third party, any state or federal law, or any administrative regulation.

You agree to indemnify and absolve Turning2Sports from any and all damages, suits, litigation, awards, and costs, including but not limited to reasonable attorneys' fees and costs, incurred by Turning2Sports arising from or in any way related to Turning2Sports's display or sale of the Property. This includes, but is not limited to, civil or criminal suits concerning the authenticity or ownership of Property, legality of sales, or claims of copyright or trademark infringement.

Counterfeit and Stolen Items

You bear the responsibility for ensuring the authenticity of all Property you submit to us. In the event that Turning2Sports is unable to verify the authenticity of any item you provide, it reserves the right, at its sole discretion, to decline acceptance of the item. If Turning2Sports concludes that an item is counterfeit, you will be notified, and you will have the opportunity to furnish proof of purchase or other authentication that meets Turning2Sports' standards.

It is important to acknowledge that any item determined by Turning2Sports to be counterfeit will not be returned and will be duly destroyed. You also recognize and consent to the fact that Turning2Sports is bound by laws and regulations pertaining to claims of counterfeit consigned items, theft, or violations of applicable law. Turning2Sports takes such reports seriously and commits to cooperating with law enforcement in all related investigations.

Payouts

After your item is sold, and the buyer retains the item beyond the eligible return period, you will receive your payout through your designated method, which may include options like PayPal, Venmo, or Turning2Sports account credit. The payout will be calculated based on the final selling price.

In the event that the item is returned, your consignment window will resume from where it left off. This provides your item with additional time to sell, and you will receive payment as soon as the item sells for the second time.

Turning2Sports shall provide all notices to you at the email address that you have provided to Turning2Sports. You are solely responsible for keeping that information current with Turning2Sports. 

You hereby agree that all agreements, notices, disclosures, and other communications that Turning2Sports provides electronically to you satisfy any legal requirement that such communications be in writing.

Dispute Resolution

In the event you wish to initiate an action, we strongly encourage you to first contact us directly at admin@turning2sports.com

If your concern remains unresolved, you commit to the following dispute resolution process: In the event of any controversy, claim, action, or dispute arising from or related to any transaction conducted through the Services, or the breach, enforcement, interpretation, or validity of these Terms or any part thereof ("Dispute"), the party asserting the Dispute shall first attempt, in good faith, to resolve it by sending a written notice to the other party (via first-class or registered mail). This notice should outline the facts and circumstances, including any relevant documentation, of the Dispute and afford the receiving party a 45-day period to respond to or settle the matter.
